What is a Freelance Solicitor
You will instruct me as a Freelance Solicitor who is authorised to provide legal advice and representation at Court by the Solicitors Regulation Authority. I am not employed by a Firm of Solicitors, and your contract is directly with me.
There are a number of things which I must explain to you below about your relationship with me as a freelance solicitor.
Professional Indemnity Insurance.
As a Freelance Solicitor I am not required by the Solicitors Regulation Authority to meet SRA minimum terms and conditions for Professional Indemnity Insurance which would ordinarily require a firm of solicitors to have access to at least £2 million of indemnity cover. This is the level of cover that a solicitor would be expected to have if they were carrying out high value property transactions and as I do not carry out this type of work.
I am required to have adequate and appropriate insurance for Professional indemnity cover. This means that in the unfortunate event that you suffer a loss because of my negligence any claim may be covered by this insurance.
I hold a Professional Indemnity Insurance policy, issued by Travellers Insurance providing £500,000 of cover for professional negligence. I have assessed that this level is cover is adequate and appropriate for the risks associated with the legal work that I will carry out. If you require any additional information about this cover or are concerned that the level of cover provided it is insufficient to protect you, please let me know. Details about the cover can be provided upon written request.
Client Money.
I cannot hold any money on behalf of any client as a Freelance Solicitor.
Costs
I work on a fixed fee basis. This means that I will have assessed the work that is required and the likely costs of completing the work and I will provide you with an invoice covering the work that you need me to do.
The fixed fee agreed is payable before any work is carried out. The Fixed fee will cover all work up to the point stated in the invoice. If additional work is required, for example if a case is adjourned part heard then there may be an additional charge for attending any additional hearings or any other additional services that you request from me. If I have to cease work because of a conflict of interest has arisen and I am unable to act for you the fixed fee is non refundable.
I reserve the right to apply to come off the Court Record and stop work if the fixed fee invoice has not been paid in full.
In addition to me fee I will also add to my invoice any Court fees, search fees, licence application fees and any other fees that will need to be paid on your behalf.
My fees are not subject to VAT.
Please note that if any invoice has not been paid within 30 days of its delivery to you, I may charge you interest on the outstanding amounts.
