Transport Manager Hearings
Transport Managers are often called to Public Inquiries alongside operators, to explain any shortcomings in their own effective and continuous transport management .
Traffic Commissioners will need to hear independent evidence from the Transport Manager about the reasons why the operator has failed to keep its promises to operate lawfully. This evidence may contradict the operator's evidence and the Traffic Commissioner will need to decide if it is the operator or the transport manager who is more culpable for the shortcomings.
It is rarely appropriate for operator and transport manager to have the same legal representation at a Public Inquiry. Transport Managers face losing their good repute or being disqualified from being nominated as a Transport Manager if the Traffic Commissioner decided they are culpable for the Operator's shortcomings.
